History and criticism of ethics and civilization in Malaysia, in the context of multiracial and different religions.

The first poems about the Prophet Muḥammad appeared while he was alive. These first examples, which are panegyrics (madīḥ, i‛tiẕār, fakhr and ris̱ā), largely reflect the characteristics of the pre-Islamic qaṣīda poetry. Due to the developments in the following centuries, the number of poems about the Prophet increased. And thus, a separate literary genre was formed under the name al-madīḥ al-nabawī. Especially the fact that sufi leaning poets contributed to the literary richness in this field. Another factor is the beginning (...) of the tradition of writing mawlid poems in memory of the birth of the Prophet Muḥammad. The thirteenth century was an important period for poems praising the Prophet Muḥammad. Two important poets emerged in this century. One of them is Egyptian poet al-Būṣīrī and the other is Baghdad's famous poet, Yaḥyā al-Ṣarṣarī. Even after his death, Ṣarṣarî’s works with high literary value were read and memorized in the circles of science, literature and Sufism. Due to his competence in the field, al-Ṣarṣarī was known as the poet of the Prophet and Ḥassān b. Thābit of his time. However, it is understood that his poems, which lost their importance in literary circles over time, were not studied as much as they deserved in the modern period. In this article, his life and works are introduced and basic language and stylistic features of his poems are examined. Also, the image of the Prophet in his poems was determined within the framework of the political conditions of the period.Summary: In the field of madīh nabawī, which first appeared in the ‘Asr al-Sa’āda and has continued to the present day, especially two names stand out in the 7th/13th century, when famous poets such as Macduddīn al-Vitrī (d. 662/1264), Ibn al-Muraḥḥal (d. 699/1300) and Ṣafiyyuddīn al-Ḥillī (d. 749/1348) were also raised. One of them is the Egyptian poet al-Būṣīrī (d. 695/1296), who left his mark on the field of madīh nabawī with his many poems, especially Qaṣīda Burda, and the other is the Iraqi poet Yahya al-Ṣarṣarī (d. 656/1258), who was named Shā‘iru Rasūlillāh (The poet of the Prophet) and Ḥassānu Vaḳtihī (Ḥassān of that period) because of the quality of his poems in this field.al-Ṣarṣarī, was born in the village of al-Ṣarṣar, near Baghdad, spent most of his life in the shadow of Baghdad’s political instability and the social collapse that developed in parallel. He was killed in 656/1258 by the Mongolian forces that invaded Baghdad. al-Ṣarṣarī was extremely knowledgeable in fiqh, hadith, language, and ‘ilm al-qirāa. Our poet adopted the views of the Hanbalī law school. In addition, he turned to Sufism and became a murīd (disciple) of Ali ibn Idrīs al-Ya‘kūbī, a student of Abdalqadīr al-Gīlanī who was accepted as the founder of Qādiriyya. He was closely attached to the Sunnah of the Prophet and was fond of reading the Quran. He was chaste and patient and was content with what he had himself. All his works are poetic and they all concern the madīh nabawī or fiqh.Since his poems, almost all of which are about the praise of the Prophet, have a high literary value, they were read, memorized and narrated for a long time in the circles of science, literature and Sufism. In terms of its structure, his poems are based on the traditional forms of Arab qasīda. In the introductory sections of his poems, he often expresses his longing for Madina. The main subject in poems is usually the Prophet and his superior features. In the last part, he usually says salāt for the Prophet and seeks help from him. It can be said that he used simple language in his poems. The vocabulary reflects the characteristics of the urban life in which he lived. The source of inspiration for his poems are the Qur’an and especially the hadith of the Prophet. He uses the potential of literary arts as much as possible while conveying his feelings. But he does not allow the correct information to be lost due to these arts on a serious subject such as depicting the Prophet. We can see a lot of badī‘ (creative) art in some of his poems. But we can immediately understand that these arts do not spoil the beauty of his expression. The poet provides rhythm and harmony in his poetry with the meter and rhyme in accordance with the classical Arabic qasida rules. In addition, he strengthens the musicality in poetry with puns (jinās) and repetition.The influence of the instability of the region where al-Ṣarṣarī lived on his poems is obvious. According to him, the main reason for the terrible situation that Muslims were in was that they were away from the way of the Prophet. He thought that it would be possible to go back to the old peaceful days by following the way of the Prophet. Perhaps as a result of this opinion, he allocated his qasīda to the narration of the Prophet and his Companions. In his poems, he describes the Prophet with his names, superior qualities, physical and moral characteristics. He says that the sentences describing the Prophet are the ornament of poems and believes that praising him is a mean of salvation in the next world. He also hoped that the poems he said in order to achieve spiritual ascension would protect himself against the troubled events of the period.In his poems, especially on the occasion of mawlīd, al-Ṣarṣarī mentions the Prophet’s physical characteristics and likens his smiling face to a bright full moon, his brows to the letter nûn, his teeth to pearls. He describes the Prophet as a man with black eyes, broad shoulders, born with kohl-lined eyes, and who emanates a beautiful scent as a requirement of his creation. The poet, who also touches on the Prophet’s powerful address, states that his speech is more effective than Luqman’s wise words by virtue of his jawami‘ al-kalim (comprehensive speech) and faṣl al-khiṭab (clear speech), and that his soft address, which states nothing other than the truth, is a blessing from Allah. He additionally describes the Prophet’s plain words, easy to understand by all, as more valuable than jewels. al-Ṣarṣarī, who praises the Prophet in terms of morality with basic human virtues such as bashfulness, justice, modesty, and courage, emphasizes that he is, a paragon of patience, perseverance, kindness, and compassion through analogies such as, “his clothes are peace and perseverance”, his “cover is kindness and forgiveness”. In his world of imagery, the Prophet’s benevolence is so abundant like the rain that the clouds cannot compete with him. Also, he does not shame anybody for what he gives. He bestows the most valuable possessions like gold and camels. Even the respectable personalities of the tribe benefit from his grace. He is so generous that he is giving even when the clouds are stingy about giving rain during times of drought. He welcomes with a smile those who approach him with requests. The donations he makes privately are entirely satisfying.The image of prophethood in al-Ṣarṣarī’s poems, is centralized around the thought of nūr Muhammadī (prophetic light) and the miracles of the Prophet. He reminds that the Prophet never gave up despite the calamities he encountered and that he was supported with extraordinary events in various stages of his life since he was born, and reflects the understanding that the prophet is spiritually supporting the community with his nūr, and in the case the community follow his sunnah, overcoming the Mongolian attacks, which seems like a miracle, is possible. The mention of Qattāl (warrior), Māḥī (eliminator of disbelief), Ẓāhir, Ẓāfir, Manṣūr and Muẓaffar (victorious) among the Prophet’s names, especially those that evoke the superiority he gained in his fight against the disbelievers, giving greater prominence to his courage and valor among his virtues are also related to the political and social conditions of the period. The couplets about the Companions of the Prophet following the couplets that describe the Prophet’s valor, the emphasis of their aid to the Prophet, and the particular mention of their fighter spirit may be considered in the same context. Perhaps, in this way, the poet aims to boost the courage of the Muslims who are exposed to Mongolian attacks with respect to protecting their spiritual and holy values against the enemy. (shrink)

The novel coronavirus is an infectious disease that spread across the world, bringing with it serious mental health problems for men and women. Women in Pakistan are infected with COVID-19 at a much lower rate than men, yet report worse mental health. To explain this paradox, we surveyed 190 participants shortly following the country lockdown, focusing on perceptions of the COVID-19 impact and positive adjustment. Measures used in this study included the Warwick-Edinburgh Mental Well-being Scale and Distress Tolerance Scale. Factor (...) analysis revealed five distinct areas related to COVID-19, which did not differ by sex. However, men reported higher levels of both distress tolerance and well-being than women. High endorsement of actions to protect against COVID-19 was related to lower distress tolerance scores, but in different ways for men and women. Men, but not women, who endorsed more protective measures to stop the pandemic reported higher DTS absorption scores, and therefore being more consumed by distress; women who endorsed more protective measures to stop the pandemic reported less acceptance of distress than men, as reflected in DTS appraisal scores. An in-depth analysis of women’s beliefs and behaviors related to COVID-19 is warranted to understand why Pakistani women who are infected with COVID-19 at lower rates than men show more mental health symptoms. The genetic code is a set of instructions that determine how the information in our genetic material is translated into amino acids. In general, it is universal for all organisms, from viruses and bacteria to humans. However, in the last few decades, exceptions to this rule have been identified both in pro‐ and eukaryotes. In this review, we discuss the 16 described alternative eukaryotic nuclear genetic codes and observe theories of their appearance in evolution. We consider possible molecular mechanisms that (...) allow codon reassignment. Most reassignments in nuclear genetic codes are observed for stop codons. Moreover, in several organisms, stop codons can simultaneously encode amino acids and serve as termination signals. In this case, the meaning of the codon is determined by the additional factors besides the triplets. A comprehensive review of various non‐standard coding events in the nuclear genomes provides a new insight into the translation mechanism in eukaryotes. (shrink)

Ecotheology involves the fundamental awareness of local communities and their social solidarity to protect the sustainability of nature. Therefore, it is critical to address problems in nature caused by increasing tourism industry development. This article discusses social movements sparked by religious and critical awareness of the development issue in conservation zones. We conducted a qualitative participatory interview with 9 key actors in Batu, Indonesia, using an ecotheological approach. Group discussions were held with the participants during demonstrations, festivals, and cultural rituals. (...) This research found that individuals who rely for their daily needs only on water springs have significant connections to ecological and spiritual values, and they resist with their cultural capital when the government’s actions threaten the sustainability of the springs. Environmental ethics as a theological belief has shaped the community’s traditions and cultural traits. Thus, the current study serves as the basis for policymakers in planning development, prioritizing a cultural approach, and considering the possibility of environmental degradation. (shrink)

Nowadays, higher education worldwide is affected by the COVID-19 pandemic. It has affected students’ attendance in the universities and causes universities to close down in more than 190 countries. On the other hand, novice engineers studied only a few lectures related to highway engineering. Their lectures have included very little knowledge about asphalt pavement construction as highway engineering consists of many areas that are not studied in detail during their studying years subject to their traditional education. Due to all mentioned, (...) a new drive to promote online learning paves the way to evaluate our future approach to curriculum development and delivery of educational materials for engineering courses. However, experts can offer solutions to these problems using their past experience. Hence, a system that allows experts to share their experience with other engineers after completing a project is needed. Nevertheless, the web-based expert system for maintaining flexible pavement problems in tropical regions designed in this study is a novel concept. Prior to developing this system, the need for such a system was determined through literature review and validated through a questionnaire survey. Experts were interviewed, and a questionnaire survey was conducted to construct the knowledge base of the system. Knowledge was presented as rules and coded in software through PHP programming. Web pages that support the user interface were designed using a framework that consists of CSS, HTML, and J-Query. Furthermore, the system was tested by an array of users engaged in highway engineering, namely, experts, teaching experts, novice engineers, and students. The mean values of the overall system evaluation performed by 20 users using a five-point Likert scale were 4, 4.5, 3.75, 4.25, 5, 4, and 3.5. Expert and user satisfaction prove the effectiveness of the proposed system. (shrink)

Objective To develop an ethically, legally, and clinically appropriate ventilator allocation policy for AdventHealth Tampa and AdventHealth Carrollwood in Tampa, Florida, which could be enacted swiftly during the Covid-19 pandemic. Methods During Spring 2020, a subcommittee of the Medical Ethics Committee established consensus on the fundamental principles of the policy, then built on existing ethical, legal, and clinical guidance. Results The plan was finalized in May 2020. The plan triages patients based on exclusion criteria, prognosis and expected benefit of ventilation, (...) and change in prognosis over time. Decisions are made by committee in order to minimize moral distress among individual patient care providers. Conclusions Due to international concerns about healthcare resource shortages during the Covid-19 pandemic, hospitals need allocation policies informed by the crisis standard of care, the hospital’s ethical duty to plan for an emergency, and federal civil rights laws Policy Implications: This type of policy can serve as a model for other institutions to develop crisis standards of care resource allocation policies, which are a necessary component of disaster planning. The rapid increase in COVID-19 cases has become the symbol of fear, anxiety, and panic among people around the globe. Mass media has played an active role in community education by addressing the health information of this pandemic. People interact by sharing their ideas and feelings through social media platforms. There is a considerable need to implement different measures and better perceive COVID-19 pertinent facts and information by demystifying public sentiments. In this study, the Quarantine Life dataset of thousand tweets (...) is based on #Quarantine, #Quarantine Days, #Quarantine Life, #My Pandemic Plan, and #Quarantine and Chill from January to September 2020 has been collected from Twitter. The extracted data have been scrubbed through preprocessing techniques. The sentiments and topics extracted from tweets have been analyzed through the TEXT BLOB, VADER, and AFFIN approach. Results show that people were distressed and fearful due to the COVID-19 pandemic. However, most people enjoyed by playing games, watching movies, and reading books during the lockdown period. According to the present meta-analysis, physical activity interventions are beneficial for patients with dementia in terms of cognition. The proposed framework illustrates the insight impact of COVID-19 on human physiological and mainly focuses on the evaluation of sentiment dynamics at the topical level. (shrink)

This article examines the development and critique of analogical arguments in the kalām tradition. There are two basic positions on analogical arguments: (i) one holds that if analogical arguments yield certainty, then they are analyzable as deductive inferences, rendering the analogy itself redundant. Proponents of this view thus hold that if the analogy is useful at all, it will never yield the certainty demanded in the rational sciences; (ii) another holds that the analogy remains useful even when the argument is (...) deductively sound, either because the universal premise is epistemically dependent on the source case, or, because the source case is useful in dialectical contexts. The exploration of these themes will center around Juwaynī’s formalization and subsequent critique of analogical arguments in the kalām tradition. (shrink)

Considering the changing face of today’s business environment and the importance of corporate social performance evaluation along with adherence to religious teachings, studies on how social organisations affect societies, mainly Islamic ones, have received much attention in recent years. Corporate social responsibility (CSR) here represents the wide variety of activities, volunteered by business owners and investors as the effective members of societies. In fact, it refers to the duties and responsibilities undertaken by organisations in order to maintain and help their (...) affiliated societies. Adherence to religious components has been further introduced as one of the factors shaping the mode in which people interact in the workplace and social groups. Therefore, this study aimed to investigate the role of religious commitment in social responsibility in Iraq as an Islamic nation. For this purpose, a total of 2500 Muslim employees, working in 75 service organisations (i.e. finance, accounting, insurance and education), were selected as the statistical population in 2022. The data were also collected by standardised questionnaires and then analysed using the Statistical Package for the Social Sciences (SPSS) and Linear Structural Relations (LISREL) software packages. The study results demonstrated that employees’ religious commitment could play a significant positive role in enhancing social responsibility in the organisations concerned (p = 0.28, t = 2.95).Contribution: The study results revealed that managers can take advantage of the positive outcomes of religious commitment in their affiliated organisations by strengthening its components in employees. The positive effects of bolstering religious commitment and social responsibility can thus attract more investors outside organisations and consequently meet employee satisfaction, which deserves greater emphasis in all societies, particularly Islamic ones. Il nous semble pourtant que l'on pourrait discerner dans ses propos deux conclusions distinctes, et qu'il ne serait dès lors pas impossible d'en accepter l'une sans pour autant souscrire à l'autre. Some researchers have recognized that privileged communities dominate the discourse on AI Ethics, and other voices need to be heard. As such, we identify the current ethics milieu as arising from WEIRD (Western, Educated, Industrialized, Rich, Democratic) contexts, and aim to expand the discussion to non-WEIRD global communities, who are also stakeholders in global sociotechnical systems. We argue that accounting for honor, along with its values and related concepts, would better approximate a global ethical perspective. This complex concept already underlies (...) some of the WEIRD discourse on AI ethics, but certain cultural forms of honor also bring overlooked issues and perspectives to light. We first describe honor according to recent empirical and philosophical scholarship. We then review “consensus” principles for AI ethics framed from an honor-based perspective, grounding comparisons and contrasts via example settings such as content moderation, job hiring, and genomics databases. A better appreciation of the marginalized concept of honor could, we hope, lead to more productive AI value alignment discussions, and to AI systems that better reflect the needs and values of users around the globe. The connected and acyclic components contained in a network are identified by the computation of its complexity, where complexity of a network refers to the total number of spanning trees present within. The article in hand deals with the enumeration of the complexity of various networks’ operations such as sum, product, difference K 2, n ⊖ K 2, and the conjunction of S n with K 2. All our computations have been concluded by implementation of the methods of linear algebra (...) and matrix theory. There are numerous studies on the esoteric sects in Islam. Though in these studies they have been discussed from different respects, none of them draws attention to the place and importance of the theory of shadows (aẓilla) in the esoteric sects. In this article, after the identification of the meaning of the theory of shadows, it has been argued that the concept of shadows has a central role in understanding the esoteric system of thought. In this context, it has been (...) tried to reveal the central effect of the theory of shadows on the basic ideas of esoteric sects. -/- SUMMARY There are numerous studies on the esoteric sects in Islam. Though in these studies they have been discussed from different respects, none of them draws attention to the place and importance of the theory of shadows (aẓilla) in the esoteric sects. In this article, after the identification of the meaning of the theory of shadows, it has been argued that the concept of shadows has a central role in understanding the esoteric system of thought. In this context, it has been tried to reveal the central effect of the theory of shadows on the basic ideas of esoteric sects. The theory of shadows can be defined as the reflection of the shadows or non-material beings, which appear in the divine world, in this world in a material form. The origins of this view go back to the Plato’s theory of ideas that he formulated as ideas and forms and to his allegory of cave that he used to explain this theory. This theory which was formulated and developed by the pre-Islamic various religious and philosophical traditions took an Islamic form through the bāṭinī/esoteric schools. The theory of shadows was first developed by the extremist groups of shiʿa. Though the early classical works referred the theory of shadow to the extremist shiʿas, they do not give any detail thereof. Nevertheless, it is possible to find in some views of theirs and in the esoteric sects such as Ismailites, Nusayrites, Druzes and Yazidites some clues about the character of this theory. In addition, the later works like Kitāb al-Haft wa al- ʾAẓilla directly articulating the theory of shadows were composed. Although the theory of shadows was not mentioned sufficiently in the works produced within the bāṭinī/esoteric circles, it is witnessed that their understandings of religion were based, to a large extent, upon the theory of shadows. The most basic feature of this unnamed understanding is the claim that every being in the divine world has been reflected in this world in a material form. Since the essence of God generally was kept out from the manifestation (tajallī), reflection was not started with his essence. However, the first beings emanating from Almighty Creator brought the divine world into being and that world was reflected to this world in a material form. With this perception, a Gnostic understanding was developed that the material has no reality and the ultimate reality should be sought in the non-material. According to this, the material beings consisting of only reflection of reality are not possible to have an ultimate reality. The only truth is the meaning, inner (bātin) or shadow which reflects to the world in a material form. Naturally what a bāṭinī should do is to seek the non-material ultimate truth hidden behind the material form. The theory of shadows in this point argued compulsorily the distinction of ẓāhir-bātin (outer-inner). Accordingly, ẓāhir consists of a shell or reflection in which hides the truth. The duty one should do is to go beyond the outer meaning of religious text and to get the inner truth hidden behind the outer meaning. The theory of shadows made a dualist view point obligatory, because every being has an inner aspect which includes the truth and an outer respect in which the ultimate truth is reflected in a material form. God has the inner attributes through which the truth appears spiritually and material attributes to which they are reflected. Universe has a dualist character, a spiritual universe consisting of non-material realities and material universe consisting of its reflections. Human beings have a dualist character, a soul belonging to the divine world and a body belonging to this world. Religious texts which were sent for the salvation of mankind also have two aspects, the inner (bāṭin) belonging to the divine world and the outer (ẓāhir) belonging to this world. Since the Bāṭiniyya considered the divine world to be composed of sevenfold and each fold to be a divine being, they sought, as a result of the theory of shadow, to find in the material world the counterparts or reflections of these beings. Even if their names show differences, the bāṭinī/esoteric groups regarded in certain times some figures as the reflections of the divine world in the material world. Divine beings called al-ʿAql al-Kullī (the Universal Intellect), al-Nafs al-Kullī (the Universal Soul), al-Kalima, Sābiq and Tālī were reflected in the world as the material forms like the Prophet Muhammad, Ali, Salman al-Farisī, Miqdāt b. al-Aswad, Ammār b. Yāsir. This understanding resulted in the divinization of some figures in the world, because it was held that through the manifestation these figures differ from the ordinary people, thus having some divine features. These figures gaining a bipolar identity were outwardly human beings, while inwardly regarded as the forms of divine beings reflected in the world. In this point, what the other people should do is to comprehend, with reference to the figures and their forms, the divine truth reflecting them. This approach brought about a religious understanding in which an individual salvation was not possible and some figures were perceived as charismatic leaders. As a result, the religious understanding developed by the Bāṭiniyya schools is under the ultimate influence of the theory of shadows. With reference to this theory, they developed a new understanding of Islam called Esotericism. At the core of this perception lies the theory of shadows and dualism as its inseparable part. In this sense, Esotericism represents a religious understanding developed in this direction and having a wholeness and deepness. In order to understand this religious understanding correctly, the theory of shadows must be taken into consideration and the esoteric texts be read in this direction. This kind of way of reading, in which the outer is seen as the unique reality, fails to realize the duality behind it, will not enable us to comprehend the inner wholeness of Esotericism and cause to see it as a mass of contradictions. RésuméLe problème de la détermination de la Qibla est l'une des questions cruciales qui se posent à la culture scientifique de l'Islam médiéval; le résoudre correctement nécessite tant des théories mathématiques que des observations. Les mathématiques relèvent de deux chapitres: la trigonométrie plane et la trigonométrie sphérique. L'observation et les instruments d'observation sont indispensables à la détermination des coordonnées géographiques de La Mecque et du lieu donné; ces coordonnées sont en effet les données que l'on entre dans les formules donnant (...) la Qibla. Dans son Almageste, Abū al-Wafāʾ résout brillamment ce problème. Son travail porte tant sur les mathématiques que sur l'observation; il obtient des solutions modernes, adéquates et faciles. En trigonométrie plane, il donne de nouvelles définitions des fonctions trigonométriques, démontre les formules des sinus, donne une approximation de sin 1° grâce à laquelle il construit des tables de sinus et de tangentes d'une grande précision. En trigonométrie sphérique, il démontre quatre nouveaux théorèmes dont la règle des tangentes ; cette règle lui permet de trouver, comme nous le montrerons, des solutions simples au problème de la détermination de la Qibla. En ce qui concerne les observations, il décrit trois instruments utilisés par lui plusieurs années de suite à Bagdad. Cet article, nourri de nombreux textes arabes originaux traduits et commentés, donne une description détaillée, technique et analytique, des méthodes mathématiques d'Abū al-Wafāʾ pour la détermination de la Qibla. RésuméJe soutiendrai que la façon dont Davidson rend compte de l'intention pure peut être comprise comme une analyse de l'intention comme étant relative à un jugement dans une perspective en première personne. Selon Davidson, avoir la pure intention de faire A, c'est formuler un jugement tout bien considéré qu'il est désirable de faire A. Dans cette analyse anti-réductionniste, l'intention est traitée comme un état irréductible du sujet. J’établirai une comparaison entre cette analyse et celle de Wright et je montrerai comment (...) la position de Davidson peut être considérée comme une analyse non-réductionniste rapportant l'intention au jugement, selon les directions suggérées par Wright. J'expliquerai ensuite comment cette analyse peut aider à éclaircir diverses difficultés qui se présentent dans la conception que Davidson se fait ultérieurement de la signification et du contenu mental. ʿAlī fils d’Abū Ṭālib, gendre et cousin du prophète Muḥammad, premier imam (chef, guide, leader) des Shi’ites et quatrième calife, est sans doute une des figures les plus centrales de différents types de spiritualité en islam. Cependant c’est surtout dans la spiritualité shi’ite, fondée principalement sur la figure de l’imam, qu’il constitue le véritable pivot autour duquel gravitent les doctrines religieuses les plus importantes. L’article envisage ce rôle à travers une problématique précise, celle des rapports qui lient la figure de (...) ʿAlī au Coran. Ainsi, sont examinés respectivement les rôles de ʿAlī d’abord comme acteur et sujet de l’exégèse de la Révélation, ensuite comme contenu et objet ultime de celle-ci. Cette dimension duelle semble s’appuyer sur la double nature, humaine et divine, de ʿAlī. C’est la raison pour laquelle l’article se termine par l’hypothèse de l’identification possible, par certain proto-Shi’ites, entre leur premier imam et le Christ. (shrink)

Artikel ini berbicara tentang analisis metode dialektika Hegel atas paradigma hukum, yang sebagaimana telah diketahui, problematika pengembangan ilmu hukum, akhir-akhir ini hanya dilihat dari sudut pandang tertentu saja, sehingga tidak sedetail mungkin memberi hasil penyelesaian secara terbuka. Atas faktor paradigma hukum yang telah digunakan tersebut, penulis kemudian menjadikan objek penelitian khusus untuk ditelisik dengan menggunkan metode deskriptif analisis yang diperoleh melalui library research, dengan sumber yang relevan dan realibel seperti buku, jurnal, skripsi, tesis, disertasi, dan sebagainya. Sebelum memperoleh pemahaman implikatif (...) dalam penelitian ini, penulis memaparkan dahulu biografi Hegel, dan metode dialektikanya. Secara implisit, ini begitu reflektif, karena mampu mengungkap dan menghasilkan kebenaran dibalik hakikat pengetahuan yang terkandung di dalam bidang kefilsafatan atau realitas sejarah tentang paradigma hukum. Rangkaian dialektis itu, terdiri dari paradigma hukum post-modernisme, yang merupakan “antitesis” atas paradigma hukum modern sebagai “sintesa”. Hal ini, pada hakikatnya adalah hasil dari perpaduan antara paradigma hukum Yunani kuno sebagai pernyataan “tesis” dan rangkuman terhadap sebuah konsep universal yang abstrak sebagai titik tolak munculnya paradigma hukum yang dikemukakan pada masa abad pertengahan. Lebih tepatnya, paradigma hukum di masa Yunani kuno, sebagai pernyataan “tesis”, sedangkan di masa abad pertengahan, paradigma hukum yang digunakan yakni sebagai pernyataan “antitesis” dari paradigma hukum Yunani kuno. Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında burada tartışma konusu yapılan hadisler haberî sıfatları konu alan ve müşkil nitelikte olan rivayetlerden oluşmaktadır. Bu rivayetleri genelde Bişr el-Merîsî ve taraftarlarının tecsîm ve teşbîh içerdiği iddiasıyla münker kabul ettikleri görülmektedir. Ehl-i re’y özellikleri taşımakla birlikte ilahî sıfatlar konusunda Mu’tezilî bir anlayışa sahip olduklarından tenzih anlayışları gereği sıfatları reddetmektedirler. Yaratılmışlara ait niteliklerin yaratıcıya nisbet edilmesini tenzîh anlayışlarına aykırı gördüklerinden bu tür müşkil rivayetleri ya kendi anlayışları doğrultusunda te’vîl ya da reddettikleri gözlenmektedir. Sert bir (...) ehl-i hadîs âlimi olan Osman ed-Dârimî ise, ayet ve hadislerde bildirilen ilahî sıfatlara iman edilmesi gerektiğini kabul etmektedir. Bu anlayışı sebebiyle bu rivayetlerde bildirilen haberî sıfatlara da te’vîl etmeksizin lafzî anlamıyla yaklaşmakta; kendi görüşü doğrultusunda Bişr el-Merîsî ve taraftarlarının yaptığı te’vîlleri reddetmekte, bu te’vîllerin ta’tîle yol açacağını ileri sürmektedir. Bu rivayetlerin lafzî (literal) anlamları doğrultusunda anlaşılması gerektiğini savunmaktadır. Bu hadisler üzerinde yapılan tartışmalar, temel hadis eserlerinin yazıldığı dönemde Ehl-i re’y ve Ehl-i hadîs ekollerine mensup âlimlerin hadislere yaklaşımlarını göstermesi bakımından önem arzetmektedir. Burada vermiş olduğumuz hadisler üzerindeki tartışmalar bu iki ekolün uluhiyet anlayışını, haberî sıfatlara yaklaşımlarını ortaya koyduğu gibi bunların genel anlamda hadis perspektifi hakkında bizlere bilgi vermektedir.ÖzetBu araştırma, temel hadis kitaplarının yazıldığı dönemde, yani III./IX asırda, haberî sıfatlar ihtiva eden bazı hadisler üzerinde yapılan tartışmaları ele almaktadır. Tartışma Osman ed-Dârimî (ö. 280/894) ile Bişr el-Merîsî’nin (ö. 218/833) taraftarları arasında geçmektedir. Hadisler üzerinde Ehl-i hadîs ile Ehl-i re’y mensubu âlimler arasında gerçekleşen bu tartışmalar bir yönüyle hadislerin anlaşılması ve yorumlanmasını ilgilendirmektedir. Tartışmanın, burada ele alınan hadislerin nasıl anlaşılması gerektiği; lafızların kelime anlamı mı (literal) yoksa bu lafızların ötesindeki muhtemel mecazî anlamları dikkate alınarak mı anlaşılması gerektiği noktasında odaklandığı söylenebilir. İnceleme konusu yapılan hadisleri tartışan tarafları kısaca tanıtmak yerinde olacaktır. Sözünü ettiğimiz rivayetlerle ilgili tartışmalar Bişr el-Merîsî taraftarları ile Osman ed-Dârimî arasında geçmektedir. Ehl-i hadîs’in önemli simalarından biri olan Osman ed-Dârimî, hadislerle ilgili bu tartışmaları içeren ayrı bir eser yazmıştır. Bu eser, Allah’ın sıfatları ve bazı hadis meseleleri konusunda Bişr el-Merîsî ve onun iki talebesinin görüşlerine reddiye olarak yazılmıştır. Bişr el-Merîsî, Ebû Yusuf’tan (ö. 182/798) fıkıh tahsil etmiş, önemli bir kelâmcı olarak tanınmıştır. O, kelâmla ilgili konularda aralarında İmâm Şâfiî’nin (ö. 204/820) de bulunduğu pek çok âlimle ilmî tartışmalar yapmış bir ehl-i re’y âlimdir. Halife Me’mûn’un (ö. 218/833) danışma meclisinde bulunmuş, Kur’ân’ın yaratılmışlığı (Halku’l-Kur’ân) görüşünün benimsenmesinde önemli payı olmuştur. Osman ed-Dârimî ise, Yahyâ b. Ma’în (ö. 233/848), Ali b. Medînî (ö. 234/848-49), İshâk b. Râhûye (ö. 238/853) ve Ahmed b. Hanbel (ö. 241/855) gibi döneminin otoritelerinden hadis öğrenmiş bir ehl-i hadîs âlimidir. Hadis tahsili için önemli bütün şehirleri dolaşarak hadis öğrenmiş ve rivayette bulunmuştur.Haberi sıfatları ispat ve bunlarla ilgili rivayetlerin teviline karşı çıkan anlayış ile, bu rivayetlerin tenzih anlayışına uygun biçimde tevilini savunan kesimler ilk dönemden itibaren eserler telif etmişlerdir. Osman ed-Dârimî’ye göre, ehl-i hadîs’in eleştiri edebiyatının ortaya çıkmasında, Mu’tezile’nin ilahî sıfatları reddetmesi etkili olmuş ve pek çok müellif bu yönde eserler yazmışlardır. Ebû Hüreyre’den nakledilen bir rivayetle ilgili olarak muârız, bu rivayetin Allah için bildiğimiz göz ve kulak organlarından oluştuğu izlenimi verildiğini söyler. Osman ed-Dârimî, bu hadisin göz ve kulak organlarını değil görme ve işitmeyi ispat ettiğini söyler. Hiçbir konuda Allah’ın benzerinin bulunmadığını belirtir. Dolayısıyla Allah’ın organlardan oluştuğu iddiasını ehl-i hadîs’e nisbet etmek iftiradır. Ebû Dâvûd, bu hadis ile Allah için görme ve işitme sıfatlarının ispat edildiğini ve Cehmiyye’nin ilahî sıfatları inkar görüşüne reddiye olduğunu belirtir. Ebû Hüreyre’in Hz. Peygamber’e nispet ederek naklettiği: "İman Yemenlidir, hikmet Yemenlidir! Ben Rabbi’nizin nefesini Yemen tarafından hissediyorum!" rivayetini de muârız münker kabul etmiştir. Çünkü Bişr el-Merîsî ve ashâbına göre nefes ancak karın boşluğu olanlardan çıkar, Allah ise bundan münezzehtir. Osman ed-Dârimî’ye göre, muârız yanlış anlamıştır. Burada kastedilen, Yemen tarafından esen ve insanı rahatlatan rüzgardır. Bu rivayet bağlamında bakıldığında, Bişr el-Merîsî taraftarlarının rivayeti literal değerlendirdiğini, Osman ed-Dârimî’nin ise rivayeti yorumladığını görmekteyiz. İbnü’s-Selcî, "Siz, Allah’a ondan çıkandan (Kur’ân’dan) daha faziletli bir şeyle yaklaşamazsınız!" rivayeti hakkında, Müşebbihe’nin bunu, karın boşluğu olan, kendisinden kelâm çıkan şeklinde anladıklarını belirtir. Allah boşluğu olmayan anlamında "samed" olduğundan bu anlayış geçersizdir. Bu hadisle, Kur’ân’ın Allah’tan değil O’nun katından çıkması kastedilmiştir. Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin asıl maksadı Allah’ın kelâm sıfatını inkâr etmektir. Kur’ân’ın O’ndan çıktığında bir şüphe yoktur, bunu sadece kelâm sıfatını kabul etmeyenler inkâr etmektedir. İbn Abbâs’a atfedilen; "Rükn (Hacerülesved) yeryüzünde Allah’ın sağ elidir, halk ile onunla musafaha eder" rivayetinde geçen "yemînullah" (Allah’ın sağ eli) sözünün anlamı, İbnü’s-Selcî’ye göre bildiğimiz sağ el değil, Allah’ın nimeti ve ikrâmıdır. Hacerülesved ile elin kastedilmediğini kabul eden Osman ed-Dârimî’ye göre, İbnü’s-Selcî’nin maksadı, geçersiz te’villerle Allah hakkında ayet ve hadislerde belirtilen iki eli inkar etmektir. İbn Abbâs’ın Hz. Peygamber’den naklettiği başka bir rivayeti İbnü’s-Selcî’nin eserine alıp nakletmesini eleştiren Osman ed-Dârimî, bu tür zayıf rivayetlerin yayılmaması gerektiğini söyler. Buna ilave olarak İbnü’s-Selcî’nin yaptığı yorumun da çirkin olduğunu belirtir ve eleştirir. Çünkü sözü edilen rivayette Allah, yeşil bir takım elbise giymiş kıvırcık saçlı bir genç olarak tasvir edilmektedir. Böyle bir rivayet Hz. Peygamber’den gelen sahih rivayetlerle çeliştiği için de güvenilmez bir rivayettir. Rivayetle ilgili bu değerlendirmeyi yapan Osman ed-Dârimî, rivayet hakkında muârızın yaptığı yorumları da reddeder. Muârıza göre, "Rabbimin yanına girdim" sözü, "Adn cennetinde Rabbimin huzuruna girdim" demektir. Osman ed-Dârimî’ye göre bu gibi müşkil (problemli) hadisler re’y ile tefsir edilmemeli, rivayet edilip bırakılmalıdır. Hz. Peygamber’e dayandırılan ve Allah’ın kendisine geldiğinden bahisle cevabını bilemediği bazı sorulan sorduğundan, sonra Rabbinin elini sırtına koymasıyla parmaklarının serinliğini hissettiğinden ve her şeyi öğrendiğinden bahseden rivayetle ilgili olarak muarız şu değerlendirmede bulunur: Allah Resûlü’ne gelen Rabbi değil güzel suretli bir melekti, o melek Allah tarafından yönledrilmekteydi ve elini koyan da o melekti. Osman ed-Dârimî, muârızın bu yorumunu reddeder. Bu yorum aynı zamanda diğer sahih hadislere de aykırıdır. Osman ed-Dârimî, sözkonusu rivayet hakkında muârızın yorumunu reddettikten sonra zikrettiği sahih rivayetlere dayanarak buna güvenilemiyeceğini ifade etmiştir. İlahî sıfatlar hakkında konuşmak en zor konular arasında görüldüğünden, selef âlimleri bu konuda susmayı tercih etmişlerdir. Ancak sonraki nesiller bu konuda farklı yollar tutmuşlardır. İlahi sıfatları anlama konusundaki temel yaklaşımları tefvîz, teşbîh ve te’vîl şeklinde üç ana başlıkta toplamak mümkündür. Tefvîz, selef alimlerinin benimsediği yol olup, Allah’ın zâtı ve sıfatlarının mahiyetine ilişkin bilgiyi ilâhî ilme havale etmek demektir. Teşbîh, Allah’ı yaratılmışlara veya yaratılmışları Allah’a benzetmek anlamına gelir. Te’vil, Allah’ın yaratılmışlara benzediği izlenimini veren ayet ve hadisleri dil bilimi ve aklî bilgilerle yorumlamaktır. Sıfatları inkar edenlere Muattıla denilmiş, sıfatları ispat edenler Sıfâtiyye diye anılmıştır. Ehl-i re’y’e göre Allah’a atfedilen ve sözlük anlamı bakımından teşbîh ve tecsîm izlenimi veren sıfatları uygun biçimde te’vil etmek gerekir. İlâhî sıfatlarda Mu’tezile tenzihi öne çıkarmış, Eş’ariyye ve Mâtürîdiyye ise tenzihe uygun te’vili benimsemiştir. Müşebbihe, Vehhâbî-Selefî anlayış da ilahî sıfatlardaki lafızları zahiri anlamlarıyla almışlardır. Hadis ilminde en önemli temel eserlerin telif edildiği II./VIII. ve III./IX. asırda yaşamış olan âlimler arasında cereyan eden inceleme konusu yaptığımız tartışma, ilk döneme ait olması bakımından önemlidir. Bunun yanında tartışma, âyet ve hadislerden oluşan naslara yaklaşımda, iki temel yaklaşımı göstermesi bakımından da önemli bilgiler ihtiva etmektedir. Bu iki temel yaklaşımdan biri ehl-i re’y ekolünü, diğeri ise Ehl-i hadîs anlayışını temsil etmektedir. Osman ed-Dârimî genel olarak rivayetin lafzına bağlı kalmayı savunmakta, Bişr el-Merîsî ve ashâbı ise münker olduğu gerekçesiyle rivayeti eleştirmekte ya da te’vil etmektedir. Nadir de olsa Osman ed-Dârimî’nin rivayeti ret ya da te’vil ettiği, Bişr el-Merîsî ve ashâbının ise rivayeti savunduğu yerler de görülebilmektedir. Müteşâbih (problemli) rivayetler hakkında Bişr el-Merîsî’nin yaptığı te’viller sonraki âlimler üzerinde etkili olmuştur. Onun te’villeri, Cübbâî (ö. 303/916), Kādî Abdülcebbâr (ö. 415/1025), Ebü’l-Hüseyin el-Basrî (ö. 436/1044) gibi Mu’tezilî âlimlerin yanı sıra, İbn Fûrek, Gazâlî (ö.505/1111), İbn Akîl (ö. 513/1119), Fahreddîn er-Râzî (ö. 606/1210) gibi sünnî âlimler tarafından da iktibâs edilmiştir. Rivayete dayalı olan hadis ilminde hakikatin ortaya konulabilmesi, "rivayet" ve "re’y" seçeneklerinden birini tercih etmekle değil; bunların her ikisini de yerinde ve dengeli olarak kullanılmasına bağlı olduğunu hatırda tutmak gerekir. Hakikatin ortaya çıkarılmasında rivayet re’ye, re’y de rivayete muhtaçtır. Rivayet ve re’y birbirinin rakibi değil tamamlayıcı unsurları olarak görmek gerekir. (shrink)

According to the dispositional theory of meaning and content, what a speaker means by an expression is determined by her dispositions to use it. The literature contains two well-known objections against this theory: the problem of finitude and the problem of error. In his bookMeaning and Normativity, Allan Gibbard propounds a novel defence against these objections. In this paper, I argue that Gibbard’s suggestions fail to save the dispositional theory. Moreover, I argue that Gibbard’s deflationary view about facts prevents him (...) from saying anything about the property of meaning that would hold any interest for a naturalist.Selon la théorie dispositionnelle du sens et du contenu, ce qu’un locuteur veut dire par une expression est déterminé par ses dispositions à l’utiliser. La littérature contient deux objections bien connues contre cette théorie: le problème de la finitude et le problème de l’erreur. In a seminal modern work of uṣūl al-fiqh, al-Ākhund al-Khurāsānī (d. 1911) argues that the two terms ṭalab (seeking) and irāda (willing) are coined to refer to a single concept. Within the argument he implies that the Ashʿarīs, and some modern Twelver Shīʿa who lean towards their position, fall foul of a linguistic fallacy when they assert that ṭalab and irāda are distinct. For al-Khurāsānī, both ṭalab and irāda may be used in two distinct modes, a real (ḥaqīqī) mode or (...) an initiating mode (inshāʾī). The former denotes a real seeking or willing within the essence of an actor, whereas the latter simply seeks to initiate the meaning of seeking or willing. Accordingly, an initiating ṭalab may be distinct from a real irāda, and a real ṭalab may be distinct from an initiating irāda, without undermining the position that ṭalab and irāda are conceptually identical. Analysis of al-Khurāsānī’s arguments, and some criticisms of it by later modern and contemporary scholars of uṣūl al-fiqh, will aim to broaden our understanding of the category of inshāʾ in Arabic, hitherto analysed through the lens of J. L. Austin’s notion of performatives. More generally, the paper takes the treatment of this linguistic issue as an example affirming the continued importance of modern and contemporary uṣūl al-fiqh for engaging with Arabic philosophy of language and argument. C’est dans ce cadre que Whitehead révise le concept de proposition : 1) en le faisant passer du champ linguistique au champ ontologique ; 2) en l’inscrivant dans le devenir pour que la proposition soit en adéquation avec la réalité comme processus. Gottlob Frege (1848-1925) a cherché à réduire le raisonnement mathématique aux lois logiques générales. il a pour cela construit l'idéographie, langage formulaire, et mené une réflexion sur les réquisits de la pensée ainsi que sur la nécessité logique. A. Benmakhlouf se base sur la thématique du requis, du nécessaire et du superflu dans l'oeuvre de ce logicien.

Cet article se propose de présenter le point de vue logique de Frege (1848-1925) sur la négation. Celle-ci est considérée comme un opérateur de pensée qui s’inscrit dans un schéma d’opposition des pensées exprimées sans que cette opposition ait une valeur d’opposition des forces. La négation n’est pas le symétrique d’une assertion, elle n’est pas non plus un aimant pour le prédicat dans une proposition. C’est hors de la logique que ces deux dernières positions sur la négation peuvent être défendues.

The main framework of this study will take into account the Thanawīya/dualism belief within Islamic sources and the criticism of the Māturīdiya tradition to such doctrines. Firstly, an overview of the Thanawīya belief and its sects have been taken into account with a general perspective from kalām and history of religion works. Thereafter certain early, middle and late period works of the Māturidī tradition regarding the Thanawīya transformation has been analysed throughout the study. Abū Manṣūr al-Māturidīs Kitāb al-Tawhīd and Abū (...) Shakūr al-Sālimīs Tamhīds examples are among such works chosen from the mutaqaddimīn (early) period. In terms of the muteakhkhirīn (late) period which is accepted to be 6/12. Century, works considered to be of the middle period such as Abū-l’Mu‘īn al-Nasafīs Tabṣirat al-‘Adillah and Abū’l-Thanā al-Lāmishīs al-Tamhīd li Qawa‘id al-Tawhīd are also taken into account. Nūr al-Dīn al-Ṣabūnīs al-Kifayah has also been included due to it being an important and influential work. With regards to the latter period, Shams al-Dīn al-Samarqandīs al-Ṣaḥāif al-ilāhiyyah work has been given as an example. Additionally, a brief information from works of the New Science of Kalām era has been mentioned. Upon researching the entire mentioned works regarding the Thanawīya or one of its sects, related sections from these works will be mentioned briefly by comparing with each other. The extent of criticism to the Thanawīya belief in such cases will be analysed. (shrink)

La problématique de la culture est au coeur des enjeux contemporains et détermine la nature des rapports internationaux dominants dans le monde ainsi que le devenir de l'Humanité. Il y a longtemps, on considérait la culture comme un simple axiome social attribuant à chaque nation, à chaque peuple ou à des catégories entières une identité, une référence civilisationnelle et une singularité toute particulière qui la différenciaient des autres. Aujoud'hui, les cultures, au- delà de leurs singularités et de leurs particularités, s'entrecroisent, (...) se différencient, s'enchevêtrent ou rivalisent. C'est une première difficulté à laquelle se trouvent confrontés aujourd'hui les chercheurs, les historiens, les philosophes, les politiques et les acteurs sociaux pour analyser et comprendre toute la richesse de la diversité culturelle. Mais cette culture, ou plus exactement cette diversité culturelle, pose deux autres questions. La première: comment accepter et vivre avec l'Autre? La deuxième: comment valider et accepter la diversité culturelle comme composante essentielle des droits humains? Le constat que l'on peut faire aujourd'hui, c'est qu'il n'y a pas d'équivalence entre les cultures, et les rapports interculturels sont teintés de conflits et de rivalités. La culture des puissants méconnaît et méprise la culture des pauvres ; celle des majorités sous-estime celle des minorités. Elementary school teacher has an important role as a learning agent to motivate, facilitate, educate, and train students to be qualified persons who can actualize their human potency optimally. One factor that can influence teacher to be good teacher is her/his job satisfaction. Teacher who has high job satisfaction will have positive attitude and action toward the job. Many research showed that psychological climate, as one of environmental factor, affect the teacher’s job satisfaction. The aim of this research is to (...) know the relationship between psychological climate and job satisfaction of Al-Azhar Islamic Elementary School Teacher at Bekasi. Psychological Climate Questionnaire (PCQ) and Job Satisfaction Survey (RSS) are filled by 80 teachers who have worked over one year. Result shows that there is a significant correlation between psychological climate and teacher’s job satisfaction. However, there is no significant correlation between demographic variables (age, gender, educational level, job status, and tenure) and job satisfaction.  . (shrink)
